Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Nathan Masachi, a sole proprietor doing business as Masachi DC, the operator of Tembo (“Tembo,” “we,” “us,” or “our”). They govern your access to and use of the Tembo mobile application, website, support services, and related services (collectively, the “Service”).

  • Last updated: September 22, 2026
  • Effective: September 22, 2026

By creating an account, accessing, or using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the Service.

1. Who may use Tembo

You must be at least 13 years old and meet any higher minimum age required in your country to use Tembo. If you are under the age of legal majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You may not use the Service if you are prohibited from receiving it under applicable law or if we previously terminated your account for a serious violation and have not authorized your return.

If you use Tembo on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

2. Your account

You agree to provide accurate information, keep it reasonably current, and maintain the security of your account and devices. You are responsible for activity conducted through your account unless caused by Tembo’s breach of these Terms or applicable law.

Do not share authentication credentials, attempt to access another person’s account, or transfer, sell, or license your account. Notify us promptly at support@heytembo.com if you believe your account has been compromised.

We may use Apple, Google, or other providers to authenticate you. Your use of those services is also governed by their terms and policies.

3. The Service

Tembo lets people create profiles, organize life into Storylines, publish Moments, discover content, follow Storylines, and use related social features. Features may vary by platform, account, location, release, or testing group.

We may add, change, suspend, or discontinue features. We will provide notice when reasonably practicable if a change materially reduces the Service you receive, but we do not promise that any feature, content, or account data will always remain available. You are responsible for keeping copies of content you cannot afford to lose.

4. Your content and ownership

“Your Content” means content you submit to the Service, including profile information, Storylines, Moments, titles, descriptions, captions, photos, reports, and support communications.

As between you and Tembo, you retain the ownership rights you have in Your Content. These Terms do not transfer ownership of Your Content to Tembo.

You represent and warrant that:

  • you own Your Content or have all rights and permissions needed to submit and use it through the Service;
  • Your Content and our permitted use of it will not violate law, these Terms, the Community Guidelines, privacy or publicity rights, intellectual-property rights, or other rights; and
  • information you provide in connection with a report or complaint is accurate to the best of your knowledge and not intentionally misleading.

You are responsible for Your Content and for choosing an appropriate audience. Do not upload content merely because you possess a copy of it; make sure you have the right to share it.

5. License you give Tembo

You grant Tembo a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, adapt for technical formatting, transmit, display, and distribute Your Content only as reasonably necessary to:

  • operate, secure, and provide the Service;
  • show Your Content to the audience you select;
  • create technical copies, thumbnails, and media variants;
  • moderate content, investigate reports, and enforce our policies;
  • maintain, troubleshoot, and improve the Service; and
  • comply with law.

This license does not give Tembo the right to sell Your Content to advertisers or use it in third-party advertising without your permission. The license ends when Your Content is deleted from our active systems, except to the extent continued processing is reasonably necessary for backups, security, moderation evidence, legal compliance, dispute resolution, or other purposes described in the Privacy Policy.

6. Tembo content and license to you

The Service, including its software, visual design, branding, logos, text, and other materials supplied by Tembo (excluding Your Content and content submitted by other users), is owned by Tembo or its licensors and is protected by intellectual-property and other laws.

Subject to these Terms, Tembo grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for lawful, personal use. No other rights are granted.

You may not copy, sell, rent, sublicense, distribute, modify, reverse engineer, bypass, scrape, or create derivative works from the Service except as applicable law expressly permits despite this restriction or we give written permission.

7. Acceptable use

You may not use Tembo to:

  • exploit, sexualize, groom, or endanger a minor, or create, possess, solicit, or distribute child sexual-abuse material;
  • threaten, promote, praise, or facilitate violence, terrorism, self-harm, or dangerous illegal activity;
  • harass, stalk, bully, intimidate, or target people with hateful conduct based on protected characteristics;
  • share non-consensual intimate imagery, sexual exploitation, or prohibited sexual content;
  • expose private personal information, confidential communications, or another person’s sensitive data without authorization;
  • impersonate others, deceive people about identity or affiliation, scam, defraud, spam, or manipulate engagement;
  • infringe copyright, trademark, privacy, publicity, or other rights;
  • upload malware, interfere with the Service, evade security or moderation controls, probe systems without authorization, or impose an unreasonable load;
  • access, collect, or use information through automated means not authorized by Tembo;
  • buy, sell, or transfer accounts or misuse invitations;
  • file knowingly false or abusive reports; or
  • violate applicable law, these Terms, or the Community Guidelines.

The Community Guidelines provide additional examples and are incorporated into these Terms.

8. Privacy, audiences, and blocking

Your use of the Service is subject to our Privacy Policy. Audience settings determine who is permitted to view content within Tembo, but they cannot prevent an authorized viewer from taking a screenshot or sharing content outside the Service.

Blocking is intended to create a safety boundary between accounts. We may change visibility, discovery, distribution, following, or interaction behavior as needed to enforce that boundary. Do not evade another user’s block.

9. Moderation, reports, and enforcement

Tembo may use automated tools and human review to detect, assess, hold, reject, limit, remove, or restore content and to investigate reports. Automated signals are not the sole basis for every serious enforcement decision.

We may take action when we reasonably believe content, conduct, or an account violates these Terms, the Community Guidelines, law, or creates risk to users or the Service. Actions may include limiting distribution or features; holding or removing content; preventing publication; restricting, suspending, or terminating an account; preserving relevant records; and contacting appropriate authorities when required or reasonably necessary to address serious safety risks.

Reports do not automatically prove a violation, and the number of reports alone does not determine guilt. We may keep the reporter’s identity confidential from the reported person.

Where appropriate and legally required, we may notify you of an enforcement action and offer a way to ask for review. We may withhold details if disclosure could create risk, compromise an investigation, expose another person’s information, or violate law.

10. Intellectual-property complaints

We respect intellectual-property rights. If you believe content on Tembo infringes your copyright or another right, email support@heytembo.com with:

  • your name and contact information;
  • identification of the protected work or right;
  • identification and location of the content you believe is infringing;
  • an explanation of why you believe the use is unauthorized;
  • a statement that the information in your notice is accurate and that you are the owner of the right or are authorized to act on the owner’s behalf; and
  • your physical or electronic signature.

We may provide your notice, including your contact information, to the person who posted the content when permitted by law. Knowingly misrepresenting that content is infringing may result in legal liability. Tembo may remove or restrict access to content and may terminate accounts that repeatedly infringe the rights of others when appropriate.

11. Feedback

If you voluntarily send ideas, suggestions, or feedback about the Service, you grant Tembo permission to use that feedback without restriction or compensation to you. This does not give Tembo ownership of Your Content.

12. Third-party services and app stores

The Service may rely on or link to third-party services. We do not control and are not responsible for third-party services, content, or practices. Your use of them may be subject to separate terms.

If you downloaded the app through Apple App Store or Google Play, the applicable store’s terms also apply. To the extent these Terms provide usage rules that are less restrictive than the store’s rules, the store’s rules apply.

For an app obtained through Apple App Store, you acknowledge that:

  • these Terms are between you and Tembo, not Apple;
  • Apple has no obligation to provide maintenance or support for the app;
  • to the extent required by applicable law, Tembo, not Apple, is responsible for the app and for addressing claims relating to it;
  • if the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by Apple’s terms;
  • you are not located in a country subject to a U.S. government embargo and are not listed on a U.S. government prohibited- or restricted-party list;
  • you must comply with applicable third-party agreement terms when using the app; and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the provisions that apply to them.

13. Account deletion and termination

You may stop using Tembo at any time. You may delete your account through Persona → Settings → Account → Delete account, or request help at heytembo.com/support.

When Tembo accepts an account-deletion request, your account, profile, relationships, Storylines, Moments, and media become unavailable through the Service. Authentication and provider-media cleanup may finish asynchronously. Limited de-identified or restricted records may be retained for safety, security, legal, or other purposes described in the Privacy Policy.

We may restrict, suspend, or terminate your access if we reasonably believe you violated these Terms, created risk or legal exposure, repeatedly infringed rights, or if continued operation of the account is no longer reasonably practicable. Where appropriate, we will consider the nature, severity, frequency, and context of the conduct.

Sections that by their nature should survive termination will survive, including provisions about ownership, licenses needed for retained records, disclaimers, liability, disputes, and enforcement.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Tembo disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will always be available, uninterrupted, secure, error-free, or free of harmful components; that content will be preserved; or that content supplied by users is accurate, safe, or lawful. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

15. Limitation of liability

To the fullest extent permitted by law, Tembo and its owner, affiliates, licensors, service providers, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities, arising from or related to the Service or these Terms, even if advised that such damages were possible.

To the fullest extent permitted by law, the total liability of Tembo and the related parties for all claims arising from or related to the Service or these Terms will not exceed the greater of (a) the amount you paid Tembo for the Service during the 12 months before the event giving rise to the claim or (b) US$100.

These limitations do not apply where prohibited by law and do not limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or other liability that cannot lawfully be limited.

16. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Tembo and its owner, affiliates, licensors, service providers, officers, employees, and agents from claims, damages, losses, liabilities, and reasonable legal costs arising from Your Content, your misuse of the Service, or your material violation of these Terms or another person’s rights.

This section does not require you to indemnify a party for that party’s own unlawful conduct and does not apply where prohibited by law.

17. Governing law and disputes

These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-laws principles. This choice of law does not deprive you of any consumer protection available under laws that cannot be waived where you live.

Before filing a claim, you and Tembo agree to make a good-faith effort to resolve the dispute informally for 30 days. Send a written notice describing the dispute and the resolution you are requesting to support@heytembo.com.

This section does not prevent either party from bringing an eligible claim in small-claims court, seeking urgent injunctive relief, or exercising rights that cannot legally be waived.

18. Changes to these Terms

We may update these Terms as the Service changes. If a change materially affects your rights or obligations, we will provide reasonable advance notice through the Service, our website, email, or another appropriate method when required by law. Changes apply prospectively from their effective date. If you do not agree to updated Terms, you must stop using the Service and may delete your account.

19. General terms

These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement between you and Tembo about the Service. If a provision is unenforceable, it will be modified only as much as necessary, and the remaining provisions will remain effective. Tembo’s failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, financing, reorganization, or sale of assets, or by operation of law.

Headings are for convenience only. The word “including” means “including without limitation.”
